The Terms of Use (hereinafter referred to as “Terms”) govern your use of The Mall ™ (hereinafter referred to as “The Mall”) and provide information about Our Services. When you create a Mall account or use The Mall, you agree to the following Terms as well as our Privacy Policy. Agreement to the Terms constitutes a legally binding contract between you and The Mall. By using any of Our Services you are agreeing to the Terms, if you do not agree with the Terms, you may not use Our Services.

ARBITRATION NOTICE: YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. WE EXPLAIN SOME EXCEPTIONS AND HOW YOU CAN OPT OUT OF ARBITRATION BELOW.

 

Our Services:

  • The services we provide include but are not limited to all of The Mall products, features, applications, services, technologies, and software in furtherance of The Mall’s goal to revitalize the social aspect of the shopping experience through sharing your favorite brands and products with your friends, family and other users. Officially our mission statement is: Eliminate third party e-commerce websites and reinvent the e-commerce and marketing medium through the introduction of a social media framework.

Our Services are made up of the following:

  • Offering a personalized platform that combines shopping and social networking through unique, meaningful browsing and discovery of brands and their products while also allowing users to connect, browse, discover, discuss, and share their favorite content.

  • Fostering a positive, inclusive, and safe environment.

 

Who can use The Mall:

  • You must be 18 years or older to use Our Services.

  • Minors under 18 and at least 13 years of age are only permitted to use Our Services through an account owned by a parent or legal guardian with their appropriate permission and under their direct supervision.

  • Children under 13 years are not permitted to use The Mall or Our Services. You are responsible for any and all account activity conducted by a minor on your account.

 

Individual User and Community Conduct:

  • Cultivate worthwhile and significant interactions.

  • Be respectful to other users.

  • Be respectful to other user’s privacy.

  • Follow the law. Always follow the law!

 

You are not allowed to:

  • Share sexual content involving minors or threaten to share intimate images of others.

  • Discriminate based on: Race; Color; Ethnicity; National origin; Religion; Gender; Gender identity; Sexual orientation; Disability; Or any other characteristic protected under applicable law.

  • Impersonate others or provide inaccurate information.

  • Spam.

  • Be vulgar or obscene.

  • Be unlawful, misleading, or fraudulent.

  • Use the app for illegal or unauthorized activities.

  • Violate our Terms or Privacy Policy (incorporated by reference) or encourage others to do so.

  • Interfere or impair the operation of The Mall or Our Services.

  • Create accounts or access or collect information in unauthorized ways.

  • Buy, sell, or transfer any aspect of your account (including your username) or solicit, collect, or use login credentials or badges of other users.

  • Post private or confidential information or do anything that violates someone else's rights, including intellectual property.

  • Use a domain name or URL in your username without our prior written consent.

 

Payment Terms:

 

Overview:

  • The Mall Payments allows buyers to make payments by authorized credit and debit card transactions through Stripe. 

  • If you are under the age of eighteen (18), you may use the payment features on The Mall only with the involvement of your parent or guardian.

  • You agree that we may communicate with you electronically any important information regarding your payments or your account.

 

Refunds, Returns, Exchanges and Disputes:

  • Reaching Out To The Vendor. You should first contact the Vendor to resolve your issue with a purchase. The Vendor has 2 business days to respond to you and attempt to resolve your issue.

  • Refunds & Returns & Exchanges. If you are requesting a refund, remember to contact the Vendor within the return period specified in the product listing and follow the merchant's instructions for returning the delivered item.

  • The Mall has no liability for underlying transactions. When you enter into a transaction with a Mall Vendor and have a dispute over the goods you purchased, we have no liability for the goods or services underlying the transaction.  Our only responsibility is to handle your payment transaction. All payments are final unless otherwise required by law. If you order something that becomes unavailable before it can be provided to you, you may request a refund of your payment.

  • If you need our help. If the Vendor is unresponsive or is not following their stated return policy, please contact us at support@themallapp.co .

 

Updating These Terms:

  • We may need to make changes to our Terms of Use to reflect Our Services and policies. Unless otherwise required by law, we will notify you (for example, through Our Service) before we make changes to these Terms of Use and will give you an opportunity to review them before they go into effect. Then, if you continue to use Our Service, you will be bound by the updated Terms of Use. If you do not want to agree to these or any updated Terms of Use, you can delete your account.
